Welcome to our website. These terms govern the relationship between IOTECNIA SL and its users, and also set out the conditions of use and contractual terms. 1. PURPOSE

1.1. Identification of the service provider
In accordance with Article 10 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, the service provider is IOTECNIA SL, Tax ID B16729725, registered address BARBERA DEL VALLES (08210), Av. Puig dels Tudons, 6, and registered in the Barcelona Commercial Registry, Volume 46748; Folio 193; Sheet B-529648, Entry 1st; email address hi@weareyouin.com.
1.2. Acceptance of terms and conditions
This document constitutes an agreement between the service provider, IOTECNIA SL, and the User who subscribes to it, who may also be referred to as the Customer or purchaser throughout these conditions. This agreement encompasses the terms and conditions (including the Privacy Policy), this document and any other attached document, notice, appendix, amendment and/or modification.
Users or Customers are those who use our services and purchase our products via the website https://weareyouin.com/
Use of the account and/or purchase of our products is subject to the privacy and security policy, which explains how we collect, use, disclose and manage all information provided by the User.
By accessing and using the User account or any other service offered, the User understands, accepts and agrees to comply with the terms and conditions of this agreement, as well as the privacy policy published by IOTECNIA SL.
If you do not agree with the content of the terms and conditions of this agreement, please do not use our services.
By accepting the terms and conditions of this agreement, the User agrees that:
They have the legal capacity to enter into contracts, acknowledging that this agreement is legally binding on both parties.
The validity and force of this Agreement shall remain in effect even if one of the clauses and/or provisions of the contract is declared non-compliant with the law or unenforceable.
1.3. Duration and modifications of service conditions
These conditions were drafted on 31/03/2022 and shall enter into force immediately upon publication on our website.
IOTECNIA SL may modify these Conditions at any time and without prior notice, in accordance with applicable legislation, including economic conditions, for legal, technical, operational, economic, service or market reasons, or due to the organisation or needs of the service, as well as any modifications aimed at adapting these conditions to changes in our business or market fluctuations. In such cases, we will inform you of these modifications so that you may accept them and continue as a User of our website.
1.4. Language of the original Agreement
This Agreement was drafted in accordance with the linguistic criteria of Spanish. Any translation of this document may contain interpretation errors. In the event of any discrepancy, the definitions and interpretations of the originally drafted document shall prevail.

2. SERVICES OF IOTECNIA SL

Our website is intended solely for adults, i.e. persons aged 18 or over, with the legal capacity to enter into agreements.

3. SERVICE FEATURES. FUNCTIONALITIES.

3.1. Access and use of our services
To access our services and purchase our products, you must register and obtain registered user status; to do so, you will need to complete the online form in which we will ask for your first name, last name, email address and password. The password is private, protected by encryption and will not be shared with third parties without your express authorisation.
The password is unique, non-transferable and confidential. As a registered user, you must use it correctly and ensure its integrity, releasing IOTECNIA SL from any liability in the event of misuse. For any incident, please contact us as soon as possible by email at hi@weareyouin.com.
3.2. Electronic communications
By registering and obtaining registered user status, the User agrees to receive all notifications and information regarding our Services and other offers electronically. These communications may be published in the User's account and/or sent to the email address provided.
IOTECNIA SL will consider electronic communications as duly notified within 5 days of their publication or distribution, regardless of whether they have been read by the User.
Consent to receive electronic notifications will remain valid until the end of the contractual relationship.
It is the User's responsibility to provide accurate data enabling IOTECNIA SL to correctly provide the contracted service, and to keep such data up to date, in particular the email address and other contact details provided at registration.
IOTECNIA SL reserves the right to terminate or modify the terms and conditions relating to electronic communications, in accordance with applicable legislation.
IOTECNIA SL will receive any comments, complaints and/or suggestions from Users confidentially at hi@weareyouin.com.
3.3. Prices
The prices of products displayed on our website are in euros, include applicable taxes and are valid at the time of purchase. Shipping costs are not included in the price, except during specific dates and/or promotions as indicated.
As a general rule, all our products are in stock. In the event of an exceptional incident preventing the transaction or if the product is not available, we will contact you as soon as possible to inform you and offer alternatives: waiting for a new delivery date, choosing a similar or superior product, or receiving a full refund.
3.4. Purchase process
To purchase our products, you must register as a registered user. You will need to complete the online form with your first name, last name, email address and password. Once this condition is met, you will be able to place your order.
The password is unique, non-transferable and confidential. The User must use it properly and ensure its security, releasing IOTECNIA SL from any liability in the event of misuse.
In the event of an incident, the User must contact us as soon as possible by email at hi@weareyouin.com.
IOTECNIA SL reserves the right to modify or temporarily suspend access to the User account or a service, with or without notice, if it considers there to be negligent or abusive use. The affected party will be notified of this situation.
You must first select the desired product, verify that it meets your expectations, paying particular attention to the description and size. The price shown is in euros and includes VAT. Click "add to cart" and customise your order by selecting the quantity and, where applicable, adding instructions for the seller in the space provided. You will then need to enter your contact details and a delivery address to calculate the shipping costs, which will be communicated to you before payment.
Payment methods
IOTECNIA SL offers the following payment methods:
1. Express payment service: via shopPay and GPay (an account on these platforms is required).
2. Bank card (please ensure your card is activated for this type of payment; if in doubt, contact your bank).
3.5. Delivery costs
Before finalising your purchase, we will inform you of the delivery cost based on the details provided.
For the shipping of accessories and/or spare parts, the cost is €4.50.
3.6. Order confirmation and invoice issuance
Once payment has been received (including delivery costs), we will send you an order confirmation to the email address provided and begin processing it. Once confirmed, the order cannot be modified, including the delivery address. For any urgent and unforeseen changes, contact us at hi@weareyouin.com. Any resulting costs will be borne by you.
If you would like to receive your invoice in electronic format, you may request it at hi@weareyouin.com. Otherwise, a paper invoice will be included with your order.

4. SHIPMENT AND ORDER TRACKING

IOTECNIA SL ships its products exclusively to mainland France. Corsica and Sardinia are expressly excluded from the delivery area.
For shipping, we use the courier company GLS-ASM, which will send you a tracking link to the email address provided. If you are absent at the time of delivery, the agency will leave a notice with instructions to reschedule the delivery, change the address or arrange a time. The courier may attempt to contact you to deliver to an alternative address or to a nearby collection point. If delivery is not possible, the parcel will be held at the depot for 10 working days before being returned to the sender.

5. WARRANTY AND RIGHT OF WITHDRAWAL

5.1. Warranty
Products purchased from 01/01/2022 are covered by a 3-year warranty, in accordance with European Directive (EU) 2019/771 of 20 May 2019 on certain aspects concerning contracts for the sale of goods.
Not covered by the warranty: damage caused by negligence, impact, incorrect use or handling, as well as normal wear and tear.
Where the warranty is invoked, repair, replacement, price reduction or refund will be applied in accordance with legal provisions.
Return costs for a product under warranty are at our expense.
5.2. Right of withdrawal
IOTECNIA SL informs you that you have 14 calendar days to exercise your right of withdrawal, without having to justify your decision. The period runs from the day on which you, or a third party other than the carrier designated by you, take physical possession of the goods.
In accordance with Article 103(c) of RDL 1/2007 of 16 November (LGCU), returns are not accepted for products manufactured according to the customer's personalised instructions, except in the event of a manufacturing defect.
5.2.1. Procedure for exercising the right of withdrawal:
To exercise this right, you must notify us of your decision by an unequivocal statement (letter or form) sent by email to hi@weareyouin.com, or by post to IOTECNIA SL, Av. Puig dels Tudons, 6, Barbera del Valles (08210).
5.2.2. Consequences of the right of withdrawal
In the event of withdrawal, we will refund all payments received, including delivery costs (except additional costs arising from your choice of a delivery method other than the least expensive standard delivery option), without undue delay and no later than 14 days after notification of your decision.
The refund will be made using the same payment method used for the purchase, unless you have expressly indicated otherwise, without any additional charges.
You must return the goods to us without delay, no later than 14 days after notifying us of your decision. The direct costs of return are at your expense.
We may withhold the refund until the goods have been received or until proof of their return has been provided.
The buyer will be responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

6. GENERAL CONDITIONS FOR PRODUCT RETURNS

7. RULES FOR USE OF OUR WEBSITE

Users must, in general, use our platform in accordance with these terms of use, good faith and applicable legislation.
Users must use our website for the purposes for which it was created, refraining from carrying out any unlawful activity, constituting an offence or infringement, harming the rights of third parties or contravening any legal standard. In particular, and by way of example only and not exhaustively, users agree to:
7.1. Not to introduce and/or disseminate, fraudulently or negligently, content or comments of a racist, child-related, xenophobic, pornographic nature, constituting glorification of terrorism, or which damage or could damage human dignity and the rights attached to it.
7.2. Not to introduce and/or disseminate, fraudulently or negligently, any information or content that infringes the fundamental rights and public freedoms recognised by Spanish law and international law.
7.3. Not to introduce and/or make available to third parties, fraudulently or negligently, any information constituting or likely to constitute unfair or unlawful advertising.
7.4. Not to disseminate or transmit, fraudulently or negligently, unsolicited or unauthorised advertising, advertising material, "spam" or "junk mail", chain letters, pyramid schemes, and in general, any content unrelated to the purposes of the Platform.
7.5. Not to introduce or disseminate, fraudulently or negligently, any false, misleading, ambiguous or inaccurate information or content that may mislead recipients.
7.6. Not to impersonate other users in the use of our Platform and to keep the access password with due diligence.
7.7. Not to disseminate, transmit or make available to third parties any information, element or content without the authorisation of the corresponding intellectual or industrial property rights holders.
7.8. Not to disseminate, transmit or make available to third parties any information or element constituting a violation of the secrecy of communications or Personal Data Protection regulations.
Users expressly release IOTECNIA SL from any liability in respect of any claim, fine, penalty or sanction that may arise from the user's failure to comply with any of the aforementioned rules of use.
IOTECNIA SL reserves the right to take any action in defence and assertion of its rights, including the right to seek compensation for any damages suffered or likely to be suffered.
IOTECNIA SL cannot guarantee that its website and services will always be available and free from interruptions. The internet is not a completely secure network and it is the responsibility of users to keep their equipment in good condition and protected against viruses, by means of appropriate software.

8. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

8.1. All content displayed on the Platform, including designs, texts, images, logos, icons, buttons, software, source codes, trade names, trademarks, or any other sign capable of industrial and/or commercial use, is protected by intellectual and industrial property rights held by IOTECNIA SL or whose exploitation has been assigned by their legitimate holders. This assignment also includes promotional services and shall remain in force for as long as you are registered on our website.
8.2. Users of our website may use the published content only on a non-exclusive, private basis, and solely to enjoy the services offered by our Platform in accordance with these conditions.
8.3. If you become aware of the existence of any unlawful, illegal content, content contrary to the law or content that may constitute an infringement of intellectual and/or industrial property rights, you must inform us as soon as possible by sending an email to hi@weareyouin.com so that we can take appropriate measures.
8.4. IOTECNIA SL is not responsible for the use that users and third parties may make of the content on our website. Commercial use of the content is prohibited, as is copying, storing, downloading, distributing, publishing, sending, transforming, decompiling the content, in whole or in part, or any use of means or procedures other than those made available on the Platform to use the content in ways other than those authorised by IOTECNIA SL.
8.5. References to trade names and registered trademarks, logos or other distinctive signs, whether belonging to IOTECNIA SL or to authorised third parties, may not be used without the corresponding authorisation of their legitimate holder. Unless otherwise provided, access to the services and content of our Platform does not grant the user any rights over the trademarks, logos and distinctive signs contained therein, which are protected by law.

9. EXTERNAL LINKS

9.1. The Platform may contain links to other websites over which IOTECNIA SL exercises no control and assumes no responsibility. Users are advised to consult the specific legal notices of those sites and to ensure they have understood and accepted them before entering into any obligation.
9.2. If, as a user of our Platform, you detect that one of these links breaches the Law or contains unlawful content, please inform us as soon as possible by email at hi@weareyouin.com.

10. ADVERTISING

IOTECNIA SL reserves the right to display advertising on the Platform. This advertising may appear in the form of a banner in the "Blog" section or be interspersed among user listings. In all cases, we undertake to present it in a non-intrusive manner and consistent with the interface design of devices, so as not to detract from the experience of users of our Platform.

11. PRIVACY POLICY

To use our website, you must read our Privacy Policy available at https://weareyouin.com/page/privacy and consent to the processing of your data by ticking the corresponding box.

12. VALIDITY AND MODIFICATIONS OF THE SERVICE CONDITIONS

These conditions were drafted on 31/03/2022 and shall enter into force immediately upon publication on our Platform.
IOTECNIA SL may modify these Conditions at any time and without prior notice, in accordance with applicable legislation, including economic conditions, for legal, technical, operational, economic, service or market reasons, or due to the organisation or needs of the service, including modifications aimed at adapting these conditions to changes in our business or market fluctuations.
IOTECNIA SL will inform you of these modifications so that you may accept them and continue using our platform. If you do not agree with the proposed modifications, you may terminate the contract without penalty, provided you inform us before they come into force. Otherwise, once in force, these modifications will be deemed accepted.

13. ARBITRATION IN DISPUTE RESOLUTION

IOTECNIA SL favours arbitration as an alternative mechanism to the Courts for the resolution of disputes between the contracting parties. The User therefore agrees to submit, as a priority over any judicial action, any dispute arising from this agreement to an arbitration procedure for definitive resolution by such extrajudicial means.
Users undertake to comply without delay with the arbitral award resulting from the procedure.
The User understands and accepts this clause, which constitutes in all respects an arbitration agreement within the meaning of Article 9 of Law 60/2003 of 23 December on Arbitration.
To this end, for the resolution of any dispute or controversy arising from this contract or legal act, including its validity, the parties agree to submit to the institutional arbitration of the Arbitration Court of Barcelona, of the Catalan Arbitration Association (TAB), — whatever its future name may be — which is entrusted with the appointment of the arbitrator or arbitrators and the administration of the arbitration in accordance with its rules in force at the beginning of the proceedings.

14. APPLICABLE LAW AND COMPETENT JURISDICTION

The parties submit, at their choice, for the resolution of disputes and waiving any other jurisdiction, to the Judges and Courts of the User's place of domicile.
