6. Arbitration for dispute resolution

IOTECNIA SL preferentially opts for arbitration as an alternative mechanism to courts for resolving disputes between contracting parties. Therefore, the user agrees to submit any dispute arising from this agreement to arbitration prior to any judicial action. Users agree to comply with the arbitration award without delay. This clause constitutes an arbitration agreement in accordance with Article 9 of Law 60/2003 of 23 December on Arbitration. Any dispute shall be submitted to the institutional arbitration of the Barcelona Arbitration Tribunal of the Catalan Arbitration Association (TAB), which will appoint the arbitrator(s) and administer the arbitration according to its rules.

7. Applicable law and jurisdiction

The parties agree, at their choice and expressly waiving any other jurisdiction, to submit disputes to the courts of the user’s place of residence.
