Welcome to our website. These terms and conditions regulate the relationship between IOTECNIA SL and its users, as well as establish the terms and conditions of use and contract
We recommend that you read them carefully, since using our services implies accepting them. If you do not agree or have doubts, please do not use our services. You can contact us by sending an e-mail to hi@weareyouin.com.

1. PURPOSE

1.1. Identification of the service owner
In accordance with Article 10 of Law 34/2002, of 11 July, on information society and electronic commerce services, the service owner is IOTECNIA SL, with Tax ID No. (NIF) B98937600 and registered office at BARBERA DEL VALLES (08210), Av Puig dels Tudons, 6, recorded in the Barcelona Companies Register, Volume 46748, Folio 193, Page B-529648, 1st entry; e-mail address hi@weareyouin.com.
1.2. Acceptance of the terms and conditions
This document comprises an agreement between the service provider, IOTECNIA SL, and the undersigned User, who may also be referred to as Customer, or buyer, throughout these terms and conditions, whereas the terms and conditions of this agreement (including the Privacy Policy), are made up of this document, as well as any other document, notice, annex, amendment and/or modification attached hereto.
The agreement refers to those who use our services and purchase our products through the https://weareyouin.com/ website as Users or Customers.

Using the account and/or purchasing our products are subject to the privacy and security policy, which establishes how we collect, use, disclose and manage all information provided by the User.
By accessing and using the User account or any other service provided, the User understands, accepts and agrees to abide by the terms and conditions of this agreement, as well as understands and accepts the privacy policy published by IOTECNIA SL.
If you do not agree with the contents of the terms and conditions of this agreement, please do not use our services.
By accepting the terms and conditions of this agreement, the User agrees that:
They have the legal capacity to contract, while accepting that this agreement legally binds both parties.
The effectiveness and duration of this Agreement will be maintained, even if any of the clauses and/or provisions of the contract are declared not in accordance with law or unenforceable.
1.3 Effectiveness and modifications of the service terms and conditions
These terms and conditions have been drawn up on 31/03/2022 and will be effective immediately from their publication on our website.
IOTECNIA SL may modify these Terms and Conditions, including any financial conditions, without prior notice, at any time and in accordance with current legislation, be it for legal, technical, operational, economic, service or market reasons, or as a result of the organisation or service needs, as well as those amendments aimed at adapting these terms and conditions to the fluctuations of our business activity or to market variations. In this event, we will inform you of these modifications so that you may accept them and continue as a User of our website.
1.4. Language of the original Agreement
This Agreement has been prepared and drafted according to Spanish language criteria. Any translation of this document may contain misinterpretations. In the event of any discrepancy, the definitions and interpretations in the originally drafted document shall prevail.

2. IOTECNIA SL SERVICES

Our website is intended for and may only be used by people of legal age, that is, above 18, and with the legal capacity to bind themselves.

3. SERVICE FEATURES. FUNCTIONS.

3.1. Access and use of our services
To access our services and be able to buy our products, you must register and get the status of registered user. To do so, you must fill in the online form, in which we will ask you for your name, surname, an e-mail address and password. The password is private, encrypted and will not be shared with third parties, except with your express authorisation.
The password is unique, non-transferable and confidential. As a registered user, you must use it correctly and ensure its integrity, exonerating IOTECNIA SL of any responsibility regarding its inappropriate use. In the event of any incident, please contact us as soon as possible by sending an e-mail to hi@weareyouin.com.
3.2. Electronic communications
By registering and becoming a Registered User, the User agrees to receive all notices and information about our Services and other offers electronically. These electronic communications may be posted in the Registered User's account and/or sent to the e-mail address provided.
IOTECNIA SL shall be duly notified, within 5 days of publication or dissemination, communications in electronic format, regardless of whether such communication has been read by the User.
Consent to receive notifications in electronic format shall be valid until the termination of the contractual relationship.
It shall be the responsibility of the User to provide real data that allows IOTECNIA SL to adequately develop the provision of the service agreement, as well as keep it updated for this purpose. Specifically for proper communication with the User; e-mail and other contact details provided in the User’s initial registration.
IOTECNIA SL reserves the right to terminate or change the terms and conditions, under which electronic communications are provided, which will be duly notified in accordance with applicable law.
IOTECNIA SL will receive any comments, complaints and/or suggestions from Users confidentially at hi@weareyouin.com.
3.3. Prices
The product prices shown on our website are in euros and include the corresponding taxes, which will be those in force at the time the purchase is made. Shipping costs are not included in the price, except on specific dates and/or promotions.
Likewise, in general, we have all the products in stock. In those cases in which, for exceptional reasons, there is some kind of incident that compromises the transaction or we do not have the product in stock, we will contact you as soon as possible to inform you of this situation and suggest alternatives to find the best solution, such as waiting for a new deadline, requesting a product with similar or superior features or a full refund of the money.
3.4. Purchasing process
To buy our product, you must register as a registered user. To do so, you must fill in the online form, where you must include your name and surname, e-mail address and password. Once you have this status, you will be able to process your order.
The password is unique, non-transferable and confidential. As a Registered User, you must use it correctly and ensure its integrity, exonerating IOTECNIA SL of any responsibility regarding its inappropriate use.
In the event of any incident, the User will contact us as soon as possible by sending an e-mail to hi@weareyouin.com.
IOTECNIA SL reserves the right to modify or temporarily interrupt access to the User’s account or part of it, or any Service, with or without prior notice, when it considers that they are being used negligently or at fault. This situation will be duly communicated to the interested party.
First, you must select the desired product and check that it really is what you are looking for, paying special attention to the product description and size. The product price is set in euros and includes Value Added Tax (VAT). Select "Add to cart" and customise your purchase by choosing the amount you want to buy and, if applicable, adding instructions to the seller in the space that we have specifically enabled for it. Then you only have to provide us with contact details and a shipping address so that we can calculate the shipping costs, which we will let you know before making the payment.

IOTECNIA SL offers you the following payment methods:
1. Express payment service: by using the shopPay and GPay services.
In these cases you must register with the corresponding payment platforms, if you are not already registered.
2. By bank card
Remember that, if you use this option, you must have this mode activated on your card. At present, almost all cards include this option, but, if in doubt, you should contact your bank.
3.5. Shipping costs
Once you choose the product you want to buy, and before completing the sale, we will inform you of the shipping costs of your purchase, according to the information you provide us.
For the shipment of accessories and/or spare parts, the cost is 4.50 euros.
3.6. Order confirmation and invoice issuance
Once we have received the amount corresponding to your purchase, including the shipping costs specified before making the payment, we will send you the confirmation of your order to the e-mail address you have submitted, and we will begin to process it within the terms set. Once the purchase is confirmed, we will not be able to modify any aspect of it, including the shipping address previously confirmed by you. However, for any urgent and unforeseen modification, you can send us an e-mail to hi@weareyouin.com, and we will try to solve it in the best possible way. Any costs incurred in this process will be at your expense.
If you wish to receive your invoice in electronic format, you can request it by sending an e-mail to hi@weareyouin.com. If you do not tell us anything, we will attach the paper invoice to the order placed.

4. ORDER SHIPPING AND TRACKING

IOTECNIA SL sends its products only within the Iberian Peninsula. The territories of the Canary Islands, Balearic Islands, Ceuta and Melilla are therefore excluded from shipment.
To ship your order we will use the GLS-ASM parcel company, which will send you a link to the e-mail address you have provided us once it receives your order, so that you can track it and know where your order is at all times. If you are not at home at the time of delivery, the shipping agency will leave you a notice with the instructions to follow from that moment onwards, providing you with a change of address or schedule. You will be able to contact the corresponding shipping agency to arrange a second delivery or pick it up. The courier will usually try to contact you to deliver it to an alternative address or to the nearest parcel pickup point. If this is not possible, the order will remain available at the destination agency, which will seek a solution, and if it does not succeed within 10 working days from the day of the first delivery attempt, the package will be returned to its origin.

5. WARRANTY AND WITHDRAWAL RIGHT

5.1. Warranty
Products purchased as of 01/01/2022 have a 3-year warranty, according to the transposition into our legal system of the provisions of the European Directive (EU) 2019/771, of 20 May 2019, on certain contracts for the sale of goods.
In relation to our products, defects caused by negligence, blows, improper use or handling, or materials subject to wear and tear due to normal use, are not included by law.
In those incidents that justify the use of the warranty, we will opt for the repair, replacement of the item, discount or refund in the legally established terms.
The costs of returning the product under warranty are at our expense.
5.2. Withdrawal
IOTECNIA SL informs you that you have the right to withdraw from this contract within 14 calendar days without justification. The withdrawal period will expire 14 calendar days from the day you or a third party appointed by you, other than the carrier, physically acquired the goods.
In accordance with the provisions of Article 103, par. C) of RDL 1/2007, of 16 November, which approves the consolidated text of the General Law for the Defence of Consumers and Users (LGCU), returns will not be accepted for those customised products made following the express instructions of the buyer, unless there are manufacturing defects.
5.2.1. Procedure for exercising the right of withdrawal:
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the agreement by means of an explicit statement (letter or the form that you will find in the following paragraph) sent by e-mail to hi@weareyouin.com or to our postal address IOTECNIA SL, Av Puig dels Tudons, 6 in BARBERA DEL VALLES, or by any means permitted by law.

5.2.2. Consequences of withdrawal
In the event of your withdrawal, we will refund the payments you have made to us, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive method we can offer you), without undue delay and, in any event, within a maximum period of 14 calendar days from the date on which we are informed of your decision to withdraw from this agreement.
We will proceed with such refund preferably using the means of payment that you have used to pay for your purchase, unless you specify otherwise. In no case may the reimbursement generate additional costs.
You must return or deliver the goods to us, without undue delay and, in any event, no later than 14 calendar days from the date on which you notify us that you exercise your right to withdraw from the purchase. You must bear the direct cost of returning the goods.
We may withhold the refund until we have received the goods or, failing that, until you provide us with proof that the goods have been returned.
The buyer shall be liable for any decrease in value of the goods, when this is the result of handling the goods other than what is necessary to establish their nature, features and operation.

6. GENERAL CONSIDERATIONS ON THE COSTS OF RETURNING THE PRODUCT

The procedure for returning products under warranty and exercising the right of withdrawal is described in these General Terms and Conditions. 7. RULES OF USE OF OUR WEBSITE

Users in general must use our platform in accordance with these terms of use, contractual good faith and current legislation.
Users must use our website in accordance with the purposes for which it was created, refraining from carrying out any type of illegal activity, constituting a crime or misdemeanour, or which infringes the rights of third parties or which violates any rule of the legal system. Specifically and by no means exhaustive, users undertake:
7.1. Not to introduce and/or disseminate, wilfully or culpably, contents, on any medium, or comments of a racist or pornographic nature or which constitute an apology for terrorism, or that violate or could violate the dignity of human beings and their inherent rights.
7.2. Not to introduce and/or disseminate, wilfully or culpably, any type of information or content on any medium that violates fundamental rights and public freedoms recognised by the Spanish legal system and international law regulations.
7.3. Not to introduce and/or make available to third parties, wilfully or culpably, any type of information on any medium that constitutes or may constitute unfair or unlawful advertising.
7.4. Not to disseminate, send, wilfully or culpably, unsolicited or unauthorised advertising, advertising material, spam or junk mail, chain letters, pyramid structures and, in general, anything that deviates from the Platform purpose.
7.5. Not to introduce or disseminate, wilfully or culpably, any information or content through any medium that is false, misleading, ambiguous, inaccurate or likely to mislead.
7.6. Not to impersonate other users in the use of our Platform and o keep the password to access it with due diligence.
7.7. Not to disseminate, send or make available to third parties any type of information, element or content without the authorisation of the holders of their intellectual or industrial property rights.
7.8. Not to disseminate, send or make available to third parties any type of information or element that involves a violation of the secrecy of communications and the regulations on Personal Data Protection.
Users expressly exonerate IOTECNIA SL of any liability for any claim, fine, penalty or sanction that may arise as a result of non-compliance by the user of any of the above rules of use.
IOTECNIA SL reserves the right to exercise any action in defence and claim of its rights, including the right to request compensation for possible damages caused or that may be caused.
IOTECNIA SL cannot guarantee that its website and services will always be available and that access will not be interrupted. The Internet is not a totally secure network, and it is the users' responsibility to keep their computers safe and in good working condition, free of viruses by using the corresponding software.

8. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

8.1. All the contents displayed on the Platform and, in particular, designs, texts, images, logos, icons, buttons, software, source codes, trade names, trademarks or any other signs liable to industrial and/or commercial use are subject to and protected by intellectual and industrial property rights owned by IOTECNIA SL or have been transferred to it for use by their legitimate owners. This assignment also includes promotional services and will be valid, as long as you are registered on our website.
8.2. Users of our website may use the content published on it on a non-exclusive basis, for their private use only, for the sole purpose of enjoying the services offered by our Platform in accordance with these conditions.
8.3 If you become aware of the existence of any content that is illicit, illegal, contrary to the law or that could involve an infringement of intellectual and/or industrial property rights, you must notify us as soon as possible by sending an e-mail to hi@weareyouin.com so that we can take the appropriate measures.
8.4. IOTECNIA SL is not responsible for the use that users and third parties may make of our website contents. The commercial use of the contents is not allowed, nor is it allowed to copy, store, download, distribute, publish, send, transform, decompile the contents or part of them, or make any use of means or procedures other than those made available on the Platform to use the contents in a manner other than that authorised by IOTECNIA SL.
8.5. References to names and commercial or registered trademarks, logos or other distinctive signs, whether owned by IOTECNIA SL or authorised third parties, may not be used without the corresponding authorisation of their legitimate owner. Unless otherwise provided, access to the services and contents of our Platform does not grant the user any rights over the trademarks, logos and distinctive signs included therein protected by law.

9. EXTERNAL LINKS

9.1. The platform may contain links to other websites, over which IOTECNIA SL has no control and for which it bears no responsibility. Users are recommended to review the specific and particular legal notices of such websites and ensure that they have understood and accepted them before assuming any type of contractual obligation.
9.2. If, as a user of our platform, you detect that any of these links infringe the law or contain any type of illegal content, please notify us as soon as possible by sending an e-mail to hi@weareyouin.com.

10. ADVERTISING

IOTECNIA SL reserves the right to display advertising on the Platform. This advertising may be displayed in the form of BANNER in its “Blog” section or interspersed between the user ads in it. In any case, we undertake to do so in a non-invasive manner and in accordance with the design of the device interface with the aim of not impairing the user experience of our platform.

11. PRIVACY POLICY

In order to use our website, you must read our Privacy Policy at https://weareyouin.com/page/privacy and consent to the processing of your data by validating the corresponding box.

12. EFFECTIVENESS AND MODIFICATIONS OF THE SERVICE TERMS AND CONDITIONS

These terms and conditions have been drafted on 31/03/2022 and will be effective immediately as of their publication on our Platform.
IOTECNIA SL may modify these Terms and Conditions, including any financial conditions, without prior notice, at any time and in accordance with current legislation, be it for legal, technical, operational, economic, service or market reasons, or as a result of the organisation or service needs, as well as those amendments aimed at adapting these terms and conditions to the fluctuations of our business activity or to market variations.
IOTECNIA SL will conveniently inform you of these changes so that you can accept them and continue as a user of our platform. If you do not agree with the proposed modifications, you may terminate the agreement without any penalty for this reason, but you must notify us before the implementation of such modifications; otherwise, once they become effective, it will be understood that you accept the these modified terms and conditions.

13. ARBITRATION IN THE RESOLUTION OF DISPUTES

IOTECNIA SL preferentially chooses arbitration as an alternative mechanism to the Courts in the resolution of disputes between the contracting parties. Therefore, the User accepts the submission, in preference to any judicial action, of any dispute arising from this agreement to an arbitration procedure for final resolution through these extrajudicial procedures.
Users undertake to comply with the arbitration award resulting from the procedure without delay.
The User understands and accepts this clause, which shall be considered for all purposes as an arbitration agreement in accordance with Art. 9 of Law 60/2003, of 23 December, on Arbitration.
To this end, for the resolution of any dispute or litigious issue arising from this agreement or legal act, including those arising from it, as well as its validity, the parties agree to submit to institutional arbitration by the Arbitration Court of Barcelona, of the Catalan Association for Arbitration (TAB) – whatever its future name may be –, which is entrusted with the appointment of the arbitrator or arbitrators and the administration of the arbitration in accordance with its Regulations in force at the beginning of the arbitration.

14. APPLICABLE LAW AND COMPETENT JURISDICTION

The parties submit, at their choice, to the Courts and Tribunals of the User's address for the resolution of disputes, waiving any other court of law.
